Terms of Service
1. About these terms
These Terms of Service (“Terms”) govern access to and use of the ViperLabs website, Studio and related services (together, the “Service”) operated by ViperLabs (“we”, “us”, “our”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
This document is a V1 operational draft for a UK digital SaaS / AI creative platform. It is not a substitute for tailored legal advice.
2. The Service
ViperLabs is an AI-powered creative platform for generating and producing images, video and audio, and for managing related projects and assets. Features, models, providers and local tooling may change as the product develops. We do not guarantee uninterrupted availability or that any particular model or workflow will remain available.
3. Accounts
You must provide accurate registration details and keep your credentials secure. You are responsible for activity under your account. You must be at least 18 years old (or the age of digital consent in your jurisdiction, if higher) to use the Service.
4. Plans, Venoms and payments
Paid features may require a subscription plan and/or Venom credits. Plan prices, Venom allowances and one-time Venom packs are described on our public pricing page and in My Account. Payments are processed by Stripe. Annual plans are charged upfront; Venoms on annual plans are released monthly over twelve months. Cancelling renewal stops future billing; access and remaining monthly Venom releases continue through the paid period unless otherwise required by law. See our Refund & Cancellation policy.
5. Acceptable use
You must not use the Service to:
- violate applicable law or third-party rights;
- generate or distribute illegal, exploitative or harmful content involving minors;
- attempt unauthorised access, interfere with or reverse engineer the Service beyond lawful interoperability;
- abuse rate limits, billing, or credit systems;
- misrepresent AI-generated content where disclosure is required by law.
We may suspend or terminate accounts that breach these Terms.
6. Your content and AI outputs
You retain rights in prompts and materials you submit, subject to licences needed for us to operate the Service. AI outputs may be similar across users and are provided without warranty of originality, accuracy or fitness for a particular purpose. You are responsible for reviewing outputs before use, including for commercial, legal or safety-critical contexts. Provider terms may also apply to models used through the Service.
7. Intellectual property
The Service, branding and software are owned by ViperLabs or its licensors. These Terms do not transfer ownership of our intellectual property to you.
8. Privacy
How we handle personal data is described in our Privacy Policy.
9. Disclaimers and liability
The Service is provided on an “as is” and “as available” basis to the fullest extent permitted by law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under UK law, including for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or statutory rights that apply to consumers.
Subject to the preceding paragraph, we are not liable for indirect or consequential loss, loss of profits, data or business opportunity, or losses arising from third-party model providers, network failures or force majeure events. Our aggregate liability arising out of or relating to the Service in any twelve-month period is limited to the fees you paid us for the Service in that period.
10. Consumers
If you are a consumer in the UK or EEA, nothing in these Terms affects your statutory rights. Cooling-off and other consumer protections may apply as described in our Refund & Cancellation policy and under applicable law.
11. Changes
We may update these Terms from time to time. Material changes will be indicated by updating the date above and, where appropriate, by notice in the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction, except that consumers may bring claims in their local courts where mandatory law so provides.
